    1. Scope

    These general conditions of sale (hereinafter referred to as “  CGV  ”) apply to all orders placed and contracts concluded (hereinafter referred to as “order”) via the website or by telephone with Fozen Lemon SA ( hereinafter referred to as “Frozen Lemon SA”) between a customer and Frozen Lemon SA

    The General Terms and Conditions are an integral part of the contract concluded between Frozen Lemon SA (“Frozen Lemon SA”) and the customer who places an order (the “  Customer  ”). By placing an order, the Customer confirms having read, understood and accepted the General Terms and Conditions without reservation. The French version takes precedence over versions in another language.

    Frozen Lemon SA reserves the right to modify the General Terms and Conditions at any time. The version of the General Terms and Conditions published on the mamipizza.ch website at the time of the order applies. In the event of differences between the General Terms and Conditions and any special conditions mentioned on the order confirmation, the latter will prevail. The version of the General Terms and Conditions cannot be modified unilaterally for the order in question.

    2. Account

    To place an order, the Customer is not required to create an account on the mamipizza.ch website . However, the customer will still be invited to create an account and during the first order (hereinafter the “  Account  ”).

    The Customer is solely responsible for the accuracy and completeness of the data he provides and must communicate any modification by updating his account, in particular, his telephone number, his e-mail and the delivery address .

    The Customer must be over 16 years old to be able to create an account on the mamipizza.ch web page and thus order on mamipizza.ch . Any communication made by e-mail to the Customer at the address indicated in their account will be considered as validly received by the Customer.

    The Customer is responsible for the use of his account and the security of his password. It is up to the Customer to manage their Account profile.  The Customer is responsible for any order placed, even without his knowledge, using his account . If the Customer suspects that a third party has improperly accessed his account, he must immediately change his password and inform Frozen Lemon SA.

    Customers' personal data is processed in accordance with the data protection policy.

    Frozen Lemon SA reserves the right to delete customer accounts in the event of suspected fraud. No reimbursement of the Customer's virtual wallet will be made. Frozen Lemon SA will not assume any liability in this regard.

    Misuse of vouchers is not permitted. In this case, Frozen Lemon SA will block and delete the account without taking responsibility for it or making refunds.

    In the event that the Customer's account is deactivated, Frozen Lemon SA is not responsible for any balance remaining on the wallet.

    3. Offer

    The offer is aimed at natural or legal persons who have their domicile or head office in Switzerland. The products are only delivered to addresses located in Switzerland and according to the rules applicable to the cities concerned. The offer is valid as long as it appears on mamipizza.ch , while stocks last.

    4. Price

    Prices are in Swiss francs, value added tax (VAT) included. Only the price indicated on mamipizza.ch at the time of the order is binding. The delivery price appears separately in the shopping cart and on the invoice.

    5. Order

    The display of products on mamipizza.ch is not legally binding. Although Frozen Lemon SA strives to provide information as complete and current as possible,  the information on the website or any other communication channel used by Frozen Lemon SA (in particular description of the products, origin of the products, photos, prices , available stocks and delivery times) are given for information purposes only . They do not constitute an offer from Frozen Lemon SA and may be modified at any time. Only the order confirmation is authentic .

    Frozen Lemon SA considers any order placed on mamipizza.ch as a request to conclude a contract with it. This is a firm and definitive offer. Any offer from the Customer is subject to prior payment of the entire price by a means accepted by Frozen Lemon SA. Payments being processed by financial intermediaries, Customers' banking details are never processed by Frozen Lemon SA.

    After transmission of the order, Frozen Lemon SA confirms acceptance of the order by e-mail, it being specified that it may at any time refuse an undelivered order without having to justify it. In this case, the Customer is informed immediately and the payments made are refunded. No compensation is due to the Customer.

    Given the short delivery times and the perishable nature of the products,  confirmed orders cannot be modified or canceled, and the delivered products cannot be returned or exchanged .

    Wine and beer orders

    Prices are per bottle as indicated next to each product. In Switzerland, the purchase of alcohol is prohibited for minors. The customer confirms by their wine order that they are at least 16 years old for beer and wine.  

    Frozen Lemon SA does not sell cigarettes

    The data recorded by Frozen Lemon SA, respectively by financial intermediaries, constitutes irrefutable proof of orders, respectively of financial transactions.

    6. Payment

    At the time of conclusion of the contract, the Customer is obliged to pay the amount of the Order to Frozen Lemon SA. All payments must be made in Swiss francs. The following payment methods are accepted: Mastercard, Visa, PostFinance, American Express, Diners Club, Discover, Twint, Google and Apple pay.

    If during an order, there is a malfunction during payment, which will generate an invoice to Frozen Lemon SA, the Customer accepts that Frozen Lemon SA will directly debit his credit card available in his Account.

    7. Delivery

    The Customer's delivery address must be in Switzerland, in an area where Frozen Lemon SA is active.

    All deliveries will be made to the address and according to the instructions given by the Customer. If the delivery information is incomplete (inaccurate contact details, impossible access, etc.) or if no person is present to receive the order, Frozen Lemon SA may release itself from its obligation to deliver by dropping off the order at the appropriate location. closer to the indicated delivery location unless the Customer immediately provides the necessary supplements. The Customer's presence during delivery is strongly recommended so that the goods are delivered in optimal conditions.

    When the Customer has opted for collection from the restaurant or point of sale, the order is deemed delivered when the Customer collects it from the restaurant or point of sale defined by giving the number relating to the order.

    The times available for deliveries are indicated on mamipizza.ch . There may be a delay between the desired delivery time and the actual delivery time, depending on traffic and external conditions in particular. Delivery times are always given as an indication and cancellation of the order by the Customer for this reason is expressly excluded.

    Delivery fees

    Delivery costs appear in the basket and on the invoice separately from the products.
